Terms of Service

The agreement between you and WalkList.

These Terms of Service ("Terms") govern your use of the WalkList apps and website (the "Service") provided by WalkList ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

WalkList is a job-site tool — not a legal or contractual record

WalkList is a punch list and project coordination tool. It is not a legal document system and does not create legally binding contracts, warranties, or guarantees between you and your customers or clients.

PDF exports and customer share links are provided for your reference and convenience. You are responsible for ensuring that any close-out documentation you use meets the contractual and legal requirements of your projects. Always consult appropriate legal or professional advisors for construction contracts and warranty obligations.

Your account

You must be at least 18 years old (or the age of majority where you live) to use the Service. You are responsible for your account, for keeping your credentials secure, and for all activity under your account — including what your team members do within your account.

Subscriptions & billing

Billing is not currently active. When billing launches, plans will be as described on the pricing page. Subscriptions purchased through the Apple App Store or Google Play are billed and managed by those stores and auto-renew until cancelled; manage or cancel in your store account settings. We will not delete your data when a subscription ends — you can still view and export it.

Your content

You retain ownership of the content you create — project data, punch list items, photos, annotations, and exports. You grant us a limited license to store, process, and display that content solely to operate the Service for you. You are responsible for the content you upload and confirm you have the right to upload it, including photos taken on job sites where others may be present.

Customer share links

When you create a customer share link, you are responsible for who you share it with. WalkList makes the linked punch list accessible to anyone with the link. Revoke links from your project settings when the job is closed or access is no longer needed.

Acceptable use

Don't misuse the Service: no unlawful use, no attempts to breach security or access other users' data, no reverse engineering, no automated scraping, and no use that interferes with the Service's operation or violates any applicable law.

Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.

Without limiting the above, we make no warranty that the Service will be uninterrupted, secure, or error-free; that exported PDFs or share links will meet any specific legal or contractual requirement; or that data stored in the Service will never be lost. You use the Service at your own risk and should maintain your own backups of critical project data.

Limitation of liability

To the maximum extent permitted by law, WalkList and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any project, contract, or business loss arising out of or relating to your use of (or inability to use) the service — even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim, or $50 USD, whichever is greater.

Indemnification

You agree to indemnify and hold WalkList harmless from claims arising out of your misuse of the Service, your content, or your violation of these Terms.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Export your data before deleting your account.

Changes

We may update the Service and these Terms. If we make material changes, we will update the "Last updated" date and may notify you in-app or by email. Continued use after changes take effect means you accept the revised Terms.

Governing law

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the jurisdiction in which WalkList is incorporated, without regard to conflict-of-laws rules.
